Disclaimer, Limitations & User Agreement

This is a legally binding agreement between you and Report Queer Hate (RQH).

1. Legal Status & Governing Law

RQH operates as an unincorporated community initiative under Australian common law. This agreement is governed by the laws of [State/Territory], Australia. Key implications:

✔ Not a registered entity (ABN exempt under GST ruling GSTB 2002/5)
✔ Not providing professional services under Australian Consumer Law
✔ No organisational liability protection exists

"Community initiative" means voluntary collective action without legal structure.

2. Strict Service Boundaries

We provide:

• A secure platform for reporting hate incidents

• Aggregated data analysis (non-commercial)

• Community-developed safety resources

We explicitly do not provide:
✗ Crisis response services (always call 000 first)
✗ Medical/legal advice (refer to QLife or Legal Aid NSW/VIC/QLD/etc)
✗ Verification or investigation of reports

3. User Responsibilities & Waivers

By using RQH, you irrevocably agree:

1. No Reliance Clause:
   "You understand RQH data is unverified and may be incomplete or inaccurate. You will not rely on it for decision-making."

2. Assumption of Risk:
   "You voluntarily assume all risks associated with using this service, including emotional distress from content."

3. Indemnity:
   "You agree to indemnify RQH volunteers against any claims arising from your use of this service."

4. Comprehensive Liability Exclusion

To the fullest extent permitted under:

• Competition and Consumer Act 2010 (Cth)

• Civil Liability Acts of relevant states

We exclude liability for:
-  Any loss/damage from use of this service
- Third-party actions based on our data
- Technical failures or data breaches

5. Critical Privacy Understandings

While we exceed Privacy Act 1988 requirements:
⚠ No absolute security: As volunteers, we cannot guarantee 100% data protection
⚠ Anonymity limitations: Technical factors may permit re-identification
⚠ Law enforcement: We may comply with valid subpoenas or warrants

6. Mandatory Pre-Reporting Notice

Before submitting any report, you agree to the following:

✅ "I understand this is not an official police report"
✅ "I will not include sensitive health/legal details"

7. Termination & Amendments

We may:

• Remove content without notice

• Block users violating these terms

• Cease operations at any time

Continued use constitutes acceptance of current terms.
